Terms of Use

1. Who we are

“Kitesurf Nation,” “we,” “us,” and “our” refer to Kitesurf Nation.

2. Eligibility

You must be at least 18 years old to create an account, post a listing, contact another user about renting, borrowing, sharing, or using equipment, or make arrangements with another user.

By using the Service, you represent that:

• You are at least 18 years old.
• You have the legal capacity to agree to these Terms.
• You will use the Service only for lawful purposes.
• You will comply with all applicable laws, rules, regulations, local beach rules, marine rules, park rules, and safety requirements.

If you use the Service on behalf of a business, club, school, rental shop, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

3. Kitesurf Nation is a platform, not a rental party

Kitesurf Nation provides a platform where users can create listings, search for equipment, contact owners, and communicate about possible rentals, loans, sharing, or other arrangements.

Unless we clearly state otherwise in the future:

• Kitesurf Nation does not own listed equipment.
• Kitesurf Nation does not inspect or certify listed equipment.
• Kitesurf Nation does not verify equipment condition.
• Kitesurf Nation does not verify user identity, address, age, ownership, skill level, certifications, insurance, or legal right to rent or lend equipment.
• Kitesurf Nation does not guarantee listing accuracy.
• Kitesurf Nation does not guarantee equipment availability.
• Kitesurf Nation does not provide rescue, instruction, supervision, safety checks, weather advice, or local-condition advice.
• Kitesurf Nation does not process payments, deposits, refunds, payouts, damage charges, late fees, or cancellation fees.
• Kitesurf Nation is not a party to any rental, lending, borrowing, sharing, pickup, return, payment, deposit, damage, cancellation, weather, or dispute arrangement between users.

Any arrangement between an equipment owner and a renter, borrower, or user is made directly between those users.

4. No insurance, protection, or guarantee

Kitesurf Nation does not provide insurance, owner protection, renter protection, borrower protection, damage protection, liability coverage, accident coverage, rescue coverage, reimbursement, guarantees, or compensation for lost, stolen, damaged, late, unsafe, unavailable, or misrepresented equipment.

Users are responsible for their own insurance and should check whether their travel, sports, personal liability, homeowner, renter, business, or equipment insurance covers the relevant activity.

Do not assume that Kitesurf Nation will reimburse you, compensate you, collect money for you, hold a deposit for you, enforce an agreement for you, or resolve a dispute for you.

5. Accounts

You may need an account to create listings, contact owners, post reviews, or use certain features.

You are responsible for:

• Providing accurate account information.
• Keeping your login credentials secure.
• All activity under your account.
• Not allowing others to use your account without permission.
• Not creating fake, misleading, duplicate, or abusive accounts.

You must notify us if you believe your account has been compromised.

We may suspend, restrict, or delete accounts that violate these Terms, create risk for other users, or harm the Service.

6. Listings

If you post a listing, you are responsible for the accuracy, legality, safety, and completeness of that listing.

You agree that:

• You have the right to list the equipment.
• The equipment is not stolen.
• The listing title, description, location, price, currency, photos, and other details are accurate.
• Photos should show the actual equipment being listed.
• You will disclose known damage, defects, repairs, missing parts, safety issues, or unusual conditions.
• You will not list equipment that you know is unsafe to use unless the issue is clearly disclosed and the equipment is not offered for unsafe use.
• You will keep your listing reasonably up to date.
• You will remove, pause, or update listings that are no longer available.

Examples of information you should disclose include:

• Cracks, delamination, leaks, soft spots, broken fins, missing straps, damaged handles, damaged foil parts, previous repairs, serious scratches, or other material defects.
• Whether fins, straps, screws, handle, leash, board bag, foil mast, fuselage, wings, kite, bar, pump, harness, or other accessories are included.
• Pickup and return expectations.
• Deposit, damage, late return, replacement, cleaning, or repair expectations.
• Any special conditions for use.

We may remove, hide, edit, or restrict listings that we believe are inaccurate, unsafe, misleading, illegal, abusive, inappropriate, or harmful to the Service.

7. Owner responsibilities

If you list equipment as an owner, lender, host, or provider, you are responsible for:

• Accurately describing the equipment.
• Providing real photos of the equipment.
• Confirming what is included and not included.
• Disclosing known damage or defects.
• Choosing a safe and appropriate pickup and return location.
• Communicating clearly with the renter, borrower, or user.
• Agreeing directly on price, currency, payment method, deposit, pickup, return, late return, damage, loss, theft, cancellation, and weather-related changes.
• Inspecting the equipment before and after handoff.
• Taking reasonable steps to avoid unsafe, fraudulent, or illegal arrangements.
• Complying with applicable laws, tax obligations, permits, business rules, insurance requirements, and local regulations.

Owners should clearly state what is included and not included, such as fins, straps, handle, screws, leash, board bag, foil mast, fuselage, wings, kite, bar, pump, harness, or other accessories.

You should not allow another person to use equipment if you reasonably believe they lack the skill, judgment, age, physical ability, safety equipment, or local knowledge needed to use it safely.

8. Renter and borrower responsibilities

If you contact an owner or use listed equipment, you are responsible for:

• Confirming the equipment details before use.
• Confirming what is included and not included.
• Confirming the price, currency, payment method, deposit, pickup, return, late return, damage, loss, theft, cancellation, and weather-related terms directly with the owner.
• Inspecting the equipment before accepting it.
• Taking photos or videos of the equipment condition before and after use where appropriate.
• Using the equipment only within your ability and experience level.
• Using appropriate safety equipment.
• Checking wind, waves, tides, currents, weather, obstacles, local rules, beach restrictions, and marine regulations.
• Not using equipment in unsafe conditions.
• Returning the equipment on time and in the agreed condition.
• Paying for damage, loss, theft, late return, cleaning, rescue costs, or other costs if you agreed to do so with the owner or if required by applicable law.

You should not use equipment if you are unsure whether it is safe, suitable, complete, or appropriate for your ability or the conditions.

9. Direct agreement checklist

Before any equipment handoff, users should agree directly on:

• Exact equipment included.
• Equipment condition.
• Existing damage or missing parts.
• Pickup time and place.
• Return time and place.
• Rental, borrowing, or sharing period.
• Price and currency.
• Payment method.
• Deposit amount and return conditions.
• Damage, loss, theft, cleaning, repair, replacement, and late-return responsibility.
• Cancellation expectations.
• Weather-related changes or cancellations.
• Whether before-and-after photos or videos will be taken.
• What happens if equipment is returned late, damaged, incomplete, or not returned.

Kitesurf Nation does not currently create, manage, enforce, or guarantee these user-to-user agreements.

10. Check-in, check-out, and equipment photos

We strongly recommend that owners and renters take clear photos or videos of the equipment at pickup and return.

Photos or videos should show:

• Overall condition.
• Existing damage.
• Fins, straps, handles, screws, leash, board bag, foil parts, or other accessories.
• Any missing or damaged parts.
• Any repairs, cracks, dents, scratches, delamination, or other defects.

These records may help users avoid misunderstandings, but Kitesurf Nation does not guarantee that photos, videos, or messages will resolve a dispute.

11. Safety and assumption of risk

Kitesurfing, kiteboarding, surfing, foiling, windsurfing, SUP, and other watersports involve serious risks, including injury, drowning, collision, equipment failure, weather-related accidents, property damage, and death.

By using the Service, you understand and agree that:

• You are responsible for your own safety.
• You are responsible for judging your own skill level.
• You are responsible for deciding whether conditions are safe.
• You are responsible for inspecting equipment before use.
• You are responsible for using proper safety equipment.
• You are responsible for following local laws, beach rules, marine rules, and safety practices.
• Kitesurf Nation does not provide safety training, rescue services, supervision, equipment inspection, or weather advice.
• Kitesurf Nation does not guarantee that any equipment is safe or suitable for you.

Do not use equipment beyond your ability. Do not use damaged equipment. Do not use equipment in dangerous weather or unsafe locations. Seek professional instruction if you are not experienced.

12. Equipment-specific prohibited use

Users must not use equipment:

• Beyond their skill level.
• In prohibited or restricted areas.
• In dangerous weather or water conditions.
• While intoxicated, impaired, or unable to use the equipment safely.
• With missing or damaged safety-critical parts.
• In a way that violates local beach, marine, park, or safety rules.
• For commercial instruction, competitions, events, racing, towing, resale, sub-rental, modification, or other special use unless the owner clearly agrees.
• In any unlawful, reckless, abusive, or unsafe way.

Owners may set additional reasonable conditions for equipment use, but those conditions must not violate law or these Terms.

13. Weather and unsafe conditions

Wind, waves, tides, storms, lightning, currents, beach closures, local restrictions, poor visibility, and unsafe conditions may affect whether equipment can be used.

Because Kitesurf Nation does not currently process bookings, payments, refunds, deposits, or cancellations, users must agree directly on what happens if conditions are unsafe or plans change because of weather or local conditions.

Users should not use equipment if conditions are unsafe, beyond their ability, or prohibited by local rules.

14. Pickup locations and personal safety

Users are responsible for arranging safe pickup and return.

We recommend:

• Meeting in safe public places.
• Avoiding private home addresses where possible.
• Confirming the other person’s identity before handoff.
• Bringing another person when appropriate.
• Avoiding cash or payment arrangements that feel unsafe.
• Not sharing unnecessary personal information.
• Trusting your judgment and cancelling if something feels wrong.

Kitesurf Nation is not responsible for user meetings, handoffs, personal safety, theft, assault, scams, or other user conduct.

15. Payments, deposits, and direct arrangements

Kitesurf Nation does not currently process payments, deposits, refunds, payouts, damage charges, cancellation fees, late fees, or replacement charges.

Any payment, deposit, refund, damage payment, late fee, replacement cost, or other financial arrangement is made directly between users.

Users are responsible for agreeing in advance on:

• Price and currency.
• Payment method.
• Deposit amount and return conditions.
• Damage responsibility.
• Loss or theft responsibility.
• Late return fees.
• Cancellation expectations.
• Weather-related cancellation expectations.
• Refund expectations.
• Cleaning, repair, or replacement cost.

Do not assume that Kitesurf Nation will collect, hold, refund, enforce, or mediate any payment or deposit.

If Kitesurf Nation later adds booking, payment, deposit, payout, damage, cancellation, or refund features, additional terms may apply.

16. Late return and non-return

Users must return equipment at the agreed time and place unless both users agree otherwise.

Kitesurf Nation does not currently charge, collect, or enforce late fees. Owners and renters are responsible for agreeing any late-return fee, extension, or consequence directly.

Failure to return equipment may result in account suspension, listing removal, platform restrictions, cooperation with lawful legal requests, and/or the owner pursuing remedies directly under applicable law.

Kitesurf Nation does not guarantee recovery of equipment or payment for late, missing, stolen, or unreturned equipment.

17. Damage, loss, theft, and disputes

Kitesurf Nation does not currently provide insurance, damage protection, owner guarantees, renter protection, liability coverage, accident coverage, or reimbursement for damaged, lost, stolen, late, incomplete, unsafe, or unavailable equipment.

Owners and renters/borrowers should inspect equipment before and after use and agree in advance on responsibility for damage, loss, theft, late return, cleaning, repairs, rescue costs, and replacement.

Kitesurf Nation may, at its discretion, review reports, remove listings, suspend accounts, restrict users, or take other platform action. However, Kitesurf Nation is not required to investigate user disputes and does not guarantee any outcome, payment, reimbursement, refund, or resolution.

Users are expected to resolve user-to-user disputes directly.

18. Taxes, permits, and legal requirements

Kitesurf Nation does not provide tax, legal, insurance, business, or accounting advice.

Users are responsible for determining whether their rental, lending, sharing, or related activity requires permits, licenses, insurance, tax reporting, business registration, or compliance with other legal obligations.

Users are also responsible for complying with local beach rules, marine rules, park rules, safety regulations, and any rules that apply to the location where equipment is used.

19. Reviews and user feedback

Users may be able to post reviews or feedback.

Reviews must be honest, relevant, and based on real interactions. You must not post reviews that are fake, misleading, abusive, discriminatory, threatening, defamatory, spam, or unrelated to the listing or user interaction.

We may remove reviews or content that we believe violates these Terms or harms the Service.

20. User content

“User content” means listings, photos, descriptions, prices, locations, messages, reviews, usernames, and any other content you submit, upload, post, or send through the Service.

You are responsible for your user content.

You represent that:

• You own or have permission to use your user content.
• Your user content does not violate another person’s rights.
• Your user content is not illegal, abusive, misleading, harmful, or inappropriate.
• Your user content does not contain viruses, malware, or harmful code.

By submitting user content, you give Kitesurf Nation a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, publish, modify for formatting, distribute, and use the content as necessary to operate, promote, protect, and improve the Service.

You retain ownership of your content, but you understand that public listings, photos, reviews, usernames, and other public content may be visible to other users and visitors.

21. Prohibited conduct

You must not:

• Use the Service for illegal purposes.
• Post stolen, fake, unsafe, or misleading equipment listings.
• Misrepresent equipment condition, availability, ownership, price, location, or included items.
• Harass, threaten, abuse, discriminate against, or harm other users.
• Spam users or send unwanted marketing messages.
• Scrape, harvest, collect, or misuse user information.
• Create fake accounts or impersonate another person.
• Upload malware, harmful code, or deceptive content.
• Interfere with the Service or attempt to bypass security measures.
• Use the Service to arrange unsafe, fraudulent, or illegal transactions.
• Post content that infringes intellectual property rights.
• Post sexually explicit, hateful, violent, or otherwise inappropriate content.
• Use another user’s personal information for any purpose unrelated to the relevant listing or user-to-user arrangement.
• Attempt to avoid or bypass these Terms.

We may remove content or restrict accounts that violate these rules.

22. User-to-user communications

Kitesurf Nation may allow users to contact listing owners or other users.

You agree to use user-to-user communications only for legitimate purposes related to listings, pickup, return, equipment questions, price, deposit, or related arrangements.

You must not use contact forms, messages, or user information for spam, harassment, scraping, marketing, phishing, scams, or unrelated contact.

If you receive another user’s personal information, you must handle it responsibly and use it only for the purpose for which it was shared.

23. No guarantee of users, listings, or equipment

Kitesurf Nation does not guarantee:

• The identity of users.
• The age of users.
• The skill level of users.
• The legal right of users to rent, lend, borrow, or use equipment.
• The condition or safety of equipment.
• The accuracy of listings.
• The availability of equipment.
• The legality of a user’s activity.
• The outcome of a user-to-user arrangement.
• That users will pay, return equipment, respond, act safely, or follow agreements.
• That any dispute will be resolved.

You are responsible for your own judgment when interacting with other users.

24. Third-party services and links

The Service may use or include third-party services, links, maps, image storage, email delivery, analytics, error monitoring, hosting, databases, security tools, or other external services.

Kitesurf Nation is not responsible for third-party websites, services, content, policies, availability, or actions.

Map locations, geocoding results, pickup pins, and displayed locations may be approximate or inaccurate. Users are responsible for confirming actual pickup and return locations directly with each other.

25. Intellectual property

Kitesurf Nation, including its name, logo, design, text, layout, software, and other materials, is owned by Kitesurf Nation or its licensors and is protected by intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, or exploit any part of the Service except as allowed by these Terms or with our permission.

If you believe content on Kitesurf Nation infringes your intellectual property rights, contact us at contact@kitesurfnation.com.

26. Privacy

Our collection and use of personal information is described in our Privacy Policy.

By using the Service, you acknowledge that we collect and use personal information as described in the Privacy Policy.

27. Legal cooperation and safety investigations

We may review, preserve, or disclose information if we reasonably believe it is necessary to:

• Comply with law.
• Respond to legal process.
• Enforce these Terms.
• Prevent fraud, abuse, spam, or security issues.
• Protect users, Kitesurf Nation, or third parties.
• Investigate safety issues.
• Cooperate with lawful requests from authorities.
• Respond to claims involving lost, stolen, damaged, unsafe, or unreturned equipment.

This section should be read together with our Privacy Policy.

28. Service changes and availability

We may change, suspend, limit, or discontinue any part of the Service at any time.

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

We may perform maintenance, update features, remove features, or change how the Service works.

29. Suspension and termination

We may suspend, restrict, or terminate your account or access to the Service if we believe that:

• You violated these Terms.
• You created risk for other users.
• You posted unsafe, illegal, or misleading content.
• You used the Service for fraud, spam, harassment, or abuse.
• Your conduct may harm Kitesurf Nation, users, or third parties.
• We are required to do so by law.

You may stop using the Service at any time.

Certain sections will continue to apply after your account ends, including sections about user responsibility, safety, disclaimers, limitation of liability, indemnity, disputes, intellectual property, and legal cooperation.

30. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Kitesurf Nation disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, safety, accuracy, availability, and reliability.

Kitesurf Nation does not warrant that:

• The Service will be uninterrupted or error-free.
• Listings will be accurate.
• Equipment will be safe, available, complete, or suitable.
• Users will act honestly, safely, or lawfully.
• User-to-user arrangements will be completed.
• Any dispute will be resolved.
• Any equipment will be returned, repaired, replaced, or paid for.

31. Limitation of liability

To the fullest extent permitted by law, Kitesurf Nation will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, use, equipment, money, or other losses.

To the fullest extent permitted by law, Kitesurf Nation is not responsible for:

• Injury, death, accident, drowning, collision, rescue, or unsafe conditions.
• Equipment damage, loss, theft, late return, or non-return.
• User disputes.
• User conduct.
• Inaccurate listings.
• Unsafe, defective, incomplete, or unavailable equipment.
• Weather, wind, waves, tides, currents, obstacles, beach closures, or local conditions.
• Payments, deposits, refunds, chargebacks, taxes, damage charges, or late fees arranged directly between users.
• Meetings, pickups, returns, or in-person interactions.
• Unauthorized access, interruptions, bugs, or technical issues.
• Third-party services or links.
• User content or public content posted on the Service.

Nothing in these Terms limits liability that cannot be limited under applicable law.

32. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Kitesurf Nation from and against any claims, liabilities, damages, losses, costs, expenses, and fees arising from or related to:

• Your use of the Service.
• Your listings or user content.
• Your rental, lending, borrowing, sharing, payment, deposit, pickup, return, cancellation, weather, damage, or user-to-user arrangement.
• Your use or misuse of equipment.
• Your injury to yourself or others.
• Your damage to equipment or property.
• Your violation of these Terms.
• Your violation of any law or third-party rights.
• Your dispute with another user.
• Your tax, permit, insurance, or legal obligations.

33. Changes to these Terms

We may update these Terms from time to time.

When we update the Terms, we will update the “Last updated” date above. If changes are significant, we may provide additional notice on the website or by email.

Your continued use of the Service after the updated Terms become effective means you accept the updated Terms.

34. Governing law

Unless otherwise required by applicable law, these Terms are governed by the laws of Japan, without regard to conflict-of-law rules.

If Kitesurf Nation is later operated through a company or legal entity in another country, this section may be updated to match that legal structure.

35. Consumer rights

Nothing in these Terms limits any consumer rights or legal rights that cannot be limited or waived under applicable law.

36. Severability

If any part of these Terms is found to be invalid, illegal, or unenforceable, the remaining parts will remain in effect.

37. No waiver

Our failure to enforce any part of these Terms is not a waiver of our right to enforce that or any other part of these Terms later.

38. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of control, or operation of the Service by another entity.

39. Entire agreement

These Terms, together with the Privacy Policy and any other policies linked from these Terms, form the entire agreement between you and Kitesurf Nation regarding the Service.

40. Language

These Terms may be translated into other languages. Unless applicable law requires otherwise, the English version controls if there is any conflict between versions.
